Welcome to Cheap Vending Machines! The terms "we", "us" and "our" refer to Cheap Vending Machines. Cheap Vending Machines operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Cheap Vending Machines is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services. Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.

SECTION 2 - ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.

To use the Services, including accessing or browsing our online stores or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our stores is correct, current and complete and that you have all rights necessary to provide this information.

You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

SECTION 3 - OUR PRODUCTS AND WARRANTIES

We have made every effort to provide an accurate representation of our products and services in our online stores. However, please note that colors or product appearance may differ from how they may appear on your screen due to the type of device you use to access the store and your device settings and configuration.

Warranty Terms:

  • Standard Warranty: All equipment purchases include a 30-day parts and labor warranty, and a 30-day parts-only warranty.
  • New Products: Please refer to manufactures manual for warranty terms and support.
  • On-Site Labor: On-site labor warranty is provided only for customers located within a 25-mile radius of zip code 76105.
  • Service Outside Area: If you are located outside our 25-mile service area, there is a $100.00 per hour labor charge for on-site repairs, or the equipment can be shipped to and repaired at our facility free of charge (shipping costs excluded).

All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer to any person, geographic region or jurisdiction.

SECTION 4 - ORDERS AND RETURNS

When you place an order, you are making an offer to purchase. Cheap Vending Machines reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until Cheap Vending Machines confirms acceptance.

Equipment Deposits:
Non-Refundable Equipment deposits are valid for 14 days. If the equipment is not picked up within this 14-day window, no refunds will be issued.

Return Policy:

  • Returns are only accepted within 24hours of receipt.
  • Items must be in their original packaging and in brand new condition.
  • The buyer is responsible for all return shipping costs.
  • A 30% restocking fee of the total sales price will be applied to all returns.

SECTION 5 - PRICES, BILLING, AND FINANCING

Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed.

Financing and Non-Payment:
If a customer has an unpaid balance on financed equipment that is over 60 days past due, Cheap Vending Machines reserves the legal right to pick up and repossess the equipment.

Litigation:
In the event of litigation for non-payment, or any other disputes or lawsuits, the legal proceedings will be held exclusively in Tarrant County or Dallas County, Texas.

SECTION 6 - SHIPPING, DELIVERY, AND INSTALLATION

All delivery times are estimates only and are not guaranteed. Once we transfer products to the carrier, title and risk of loss passes to you.

Delivery and Setup Fees:

  • Delivery and setup costs are $249.99 per machine for locations outside 25 miles of zip code 76105.
  • Each additional mile outside a 50-mile radius will be charged at a rate of $4.00 per mile.
  • Door removal (if required for placement) will incur an additional fee of $100.00.

Loading Liability:
Cheap Vending Machines and its staff are not responsible for any damage to your vehicle if we assist in or perform the loading of equipment.

SECTION 7 - INTELLECTUAL PROPERTY

Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, are owned by Cheap Vending Machines, its affiliates or licensors and are protected by U.S. and foreign patent, copyright and other intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, or republish any material without our prior written consent. Cheap Vending Machines's names, logos, and slogans are trademarks of Cheap Vending Machines or its affiliates.

SECTION 8 - OPTIONAL TOOLS

We may provide you with access to third-party tools which we neither monitor nor have any control over. You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties of any kind. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

SECTION 9 - THIRD-PARTY LINKS

The Services may contain materials and hyperlinks to websites operated by third parties. We are not responsible for examining or evaluating the content or accuracy of any third-party materials. We are not liable for any harm or damages related to the purchase or use of goods, services, or content made in connection with any third-party websites.

SECTION 10 - RELATIONSHIP WITH SHOPIFY

Cheap Vending Machines is powered by Shopify. However, any sales and purchases you make in our store are made directly with Cheap Vending Machines. You acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Cheap Vending Machines, including any injury, damage, or loss resulting from purchased products.

SECTION 11 - PRIVACY POLICY

All personal information we collect through the Services is subject to our Privacy Policy. Because the Services are hosted by Shopify, Shopify also collects and processes personal information in order to provide and improve the Services.

SECTION 12 - FEEDBACK

If you submit suggestions, reviews, or other content ("Feedback"), you grant us a perpetual, worldwide, royalty-free license to use, reproduce, and distribute such Feedback for any purpose. We are under no obligation to maintain Feedback in confidence or pay compensation for its use.

SECTION 13 - ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information in the Services that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, and availability. We reserve the right to correct any errors and to change or update information or cancel orders if any information is inaccurate at any time without prior notice.

SECTION 14 - PROHIBITED USES

You are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to infringe upon our intellectual property rights; (d) to harass, abuse, or harm others; (e) to upload or transmit viruses or any other type of malicious code; or (f) to interfere with the security features of the Service.

15.1 This section applies if you use or deploy an "Agent" (software/service taking autonomous action) to interact with the Services.
15.2 No Agent may access the Services unless it identifies itself in accordance with section 15.4.
15.3 We may limit, via technical measures, how any Agent interacts with the Services.
15.4 Requirements: Agents must disclose their name in the user agent string as "Agent/[agent name]", must not mimic human behavior to circumvent CAPTCHAs, and must respond truthfully to prompts seeking to determine if the interaction is human or computer-based.

We may terminate this agreement or your access to the Services at our sole discretion at any time without notice. You will remain liable for all amounts due up to and including the date of termination.

SECTION 17 - DISCLAIMER OF WARRANTIES

EXCEPT AS EXPRESSLY STATED BY CHEAP VENDING MACHINES (INCLUDING THE LIMITED WARRANTY IN SECTION 2), THE SERVICES AND ALL PRODUCTS ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT ANY WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED.

SECTION 18 - LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL CHEAP VENDING MACHINES, OUR DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS PROCURED USING THE SERVICES.

SECTION 19 - INDEMNIFICATION

You agree to indemnify, defend and hold harmless Cheap Vending Machines and Shopify from any claims, damages, or liabilities arising out of your breach of these Terms, your violation of any law, or your misuse of the Services.

SECTION 20 - SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms.

SECTION 21 - WAIVER; ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right. These Terms of Service constitute the entire agreement between you and us.

SECTION 22 - ASSIGNMENT

You may not assign this Agreement or any of your rights hereunder without our prior written consent. We may assign our rights and obligations without notice to you.

SECTION 23 - GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Texas. Any legal action shall be brought in the courts of Tarrant County or Dallas County, Texas.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

SECTION 25 - CHANGES TO TERMS OF SERVICE

We reserve the right to update, change, or replace any part of these Terms of Service by posting updates to our website. It is your responsibility to check our website periodically for changes.
